While some of the content and pages of the Website are free to view, but to purchase the products/services, you may need to create an account on the Jensquare platform. To create an account on Jensquare, you will be asked to complete the registration form and fill in certain details such as name, address, mobile number, e-mail id, etc. You expressly acknowledge that Jensquare will rely on the information as would be provided by you, and thus you hereby warrant that any and all information provided by you in the course of creating the account is true and accurate. You will immediately inform Jensquare of any changes to registration information, including changes in the expiration date of any credit card or charge card used in connection with the purchase of any products/services using the Jensquare platform and changes in home or billing address.

Transactions on the Jensquare platform are available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872, including un-discharged insolvents, etc., are not eligible to use the Jensquare platform. If you are a minor, i.e., under the age of 18 years, you may use the Jensquare platform or access content on the platform only under the supervision and prior consent/permission of a parent or a legal guardian.

Jensquare reserves the right, at its absolute discretion and without assigning any reason, to refuse any user from creating an account on the Jensquare platform or to suspend or cancel an account. Jensquare also reserves the right to suspend or cancel at any time and without notice the account of any user who is found to be in breach of these Terms and Conditions or if any user who, in the reasonable opinion of Jensquare, is guilty of conduct which is detrimental to the reputation of Jensquare.

You hereby confirm and acknowledge that you shall be solely responsible for maintaining the confidentiality of your username and password and restricting any unauthorized access and use of the Jensquare platform using your username and password. You will be responsible for all access to and use of the Jensquare platform through your username and password, including the purchase of any Products which results in monetary charges being imposed onto you, whether or not you have the knowledge of or authorize such access and use. You will notify Jensquare immediately of any unauthorized disclosure or use of username and password, or if you suspect the privacy of your username and password has been breached and/or jeopardized. Until Jensquare is notified of a breach in security, you will remain liable for any unauthorized disclosure or use of your username and password. You are cautioned, at your sole liability, to exercise particular care while using public networks/WIFI connection or accessing your account from public computers.

You shall not (i) select or use as a username, a name of another person with the intent to impersonate that person; (ii) use as a username, a name that is otherwise offensive, vulgar or obscene. Jensquare reserves the right to refuse registration of or cancel a username in its sole discretion. Jensquare also reserves the right, either by itself or through third parties, to offer alerts, newsletters, e-mails, and other promotional offers to you based on the preferences that you identify during the registration process and at any time thereafter from your online account and/or based on your history of purchase of products/services from Jensquare.

In the course of operating the Jensquare platform, Jensquare will be required to monitor your usage of the platform for legitimate purposes, such as (a) providing, maintaining, and developing the platform; (b) preventing, detecting, and repairing problems related to security and/or the operation of the platform; (c) creating reports, e.g., the number of products sold, revenue by each product category, etc.; and (d) improving the user experience for accessing the Jensquare platform.

Jensquare is selling products on the Website, including third-party products. Jensquare has legal authority to sell such third-party products to users via the Website.

Jensquare Private Limited is a listed seller on the Website for its owned branded products. Jensquare is only a facilitator for the products sold by Jensquare Private Limited. Jensquare provides support to Jensquare Private Limited, associated with sales through the Website. For the products sold by Jensquare Private Limited, it shall solely be responsible to the user with respect to product quality, warranty, accuracy, on-time deliveries, and respective complaints. Jensquare Private Limited shall be bound to these Terms and Conditions mentioned hereunder, to the extent related to the sales of its products through the Website.

Products:
All products listed on the Website, their descriptions, and their prices are subject to change from time to time. Jensquare Private Limited reserve the right, at any time, to modify, suspend, or discontinue the sale of their respective products or services with or without notice.

We put every effort to ensure that our Website contains correct information. However, Jensquare makes no warranty as to the accuracy, comprehensiveness, and correctness of products and information on the Website. Purchase of a product on the Website is subject to the availability of stock.

We strive to offer you the best possible rates for the product, but Jensquare does not guarantee that these prices will be minimum in the region or country or in comparison to other players in the industry. Jensquare reserves the right to change or update the price and/or other details of the product on the Website, at its discretion, without any notice to you. In the event a product or service is listed at an incorrect price or with incorrect information due to typographical error, error in pricing, or information received from Jensquare’s suppliers, Jensquare shall have the right, post the acceptance of any order, to decline or cancel any such order, whether or not the order has been confirmed and/or you have been charged for such product or service. If you have already been charged for the order and Jensquare cancels your order, the amount will be refunded.

The product specifications (weight, size, color, etc.) mentioned with the product photos displayed are only approximate. There may be a slight variation in the pictures and the respective actual products.

Every Personalised products we offer is handcrafted, there might be slight variation in the product in terms of design and shape. Occasionally, substitution materials or add-ons might be used if necessary due to temporary and/or regional unavailability issues.

In such cases, our experienced team will ensure we deliver the product as close as possible to the description/photograph shown and will only substitute with items of equal or higher value.

The message on the complimentary message card, which is provided by Jensquare, can either be printed or handwritten, depending upon where the delivery is scheduled for.

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

Products with their information are showcased on the Jensquare Website to invite offers from users. When you place an order, you are making an offer to purchase, and such offer is subject to acceptance by us. Our communication (email/SMS/push notification) acknowledging your order does not signify our acceptance of your offer. Jensquare reserves the right, after receiving the order, to accept, decline, or cancel your offer (in whole or in part). The offer shall be deemed accepted once it is dispatched for delivery by Jensquare. No other act or omission on the part of Jensquare shall be considered as acceptance of an offer or order by Jensquare. In the event of a purchase, you will be required to accurately provide the recipient’s name, contact, and shipping address. You agree that if Jensquare cancels all or part of your order, your sole and exclusive remedy is that:

Jensquare will not charge your credit/debit card or bank account for the canceled portion of the order.
For your convenience, Jensquare accepts Visa, MasterCard, RuPay, Paypal, and American Express Debit Cards, Internet Banking, Digital wallets, and UPI. Regardless of the payment method chosen, whether through the payment gateway on the website or the Jensquare mobile application, any and all payments made are subject to specific terms and conditions of such third-party payment gateways.

In the rare event that a product you have ordered is out of stock or unavailable, we are committed to ensuring your special occasions remain joyous. In such cases, we will promptly get in touch with you to present an alternative product option.

Should we be unable to reach you, our priority is to ensure that your thoughtful gesture to your loved one(s) is not affected. In such cases, we will proceed to send you the alternate product, understanding the importance of maintaining the spirit of the occasion.

Jensquare reserves the right to cancel any order for various reasons, including unforeseen circumstances that may impact the fulfillment of your order. Such circumstances may include limitations on the quantity available for purchase, errors in product(s) or pricing information, or constraints within our credit department. Before canceling any order, we will contact and notify you.

Orders scheduled for same-day delivery are processed immediately and usually cannot be modified or canceled. If the order has not been prepared or is not out for delivery, we will make every effort to accommodate your request. If the order has already been prepared or dispatched, it cannot be canceled or modified, and you will be charged for the order.

Additionally, once your order is successfully delivered, you will receive a delivery confirmation via email and SMS. Please ensure to check your registered phone number or email address for these notifications.

At Jensquare, we strive to keep you informed at every step of your order journey, ensuring a seamless and delightful shopping experience.

Jensquare is committed to delivering products to the recipient as per the delivery option selected by the user during order placement. The delivery time is subject to the location provided for delivery. To cater to the convenience and requirements of our customers, Jensquare provides two delivery options: ‘Fixed Time Deliveries’ and ‘Free Deliveries’. For fixed time deliveries, nominal charges apply and are displayed on the webpage while selecting the delivery timeframe. However, please note that fixed time deliveries are subject to factors beyond our reasonable control, such as unexpected travel delays from courier partners, weather conditions, political disruptions, strikes, war, lockdowns, or other unforeseen circumstances. In such cases, we will proactively reach out to you, so please check your emails and SMS regularly for updates.

Flower Deliveries:

• Flowers may be delivered in fully bloomed, semi-bloomed, or bud stage. The delivery cannot be redirected to any other address.

Advance Orders:

For festivals or major occasions, we recommend placing your order at least 5 (five) days in advance.

Hand Delivered vs. Courier Products:

Products that are hand-delivered cannot be delivered along with courier products. They may reach the recipient at two different times or days.

Same-Day Delivery Times:

• Standard Time Delivery: Orders must be received by Jensquare before 6:00 pm, Monday – Saturday, IST.
• Fixed Time Delivery: Orders must be received by Jensquare before 6:30 pm, Monday – Saturday, IST.
• Midnight Delivery: Orders must be received by Jensquare before 7:00 pm, Monday – Saturday, IST.

Estimated Delivery Time:

You acknowledge that the requested delivery time is non-binding. The estimated delivery time depends on product availability and the destination. Delivery may be affected by Force Majeure Events, and we will proactively reach out to you in such cases. Please check your emails and SMS regularly for updates.

Perishable Items (Cakes and Flowers):

For perishable items, we attempt delivery only once. In the event of a failed delivery due to reasons such as a wrong address, recipient not available, premises locked, or recipient refusing delivery, the order will be considered executed.

Late Delivery and Solutions:

If there is no one available at the shipping address to accept the delivery at the time of delivery, the order will not be considered late. In such cases, no refunds, cancellations, or liability can be claimed. Our efforts to complete the delivery include calling the recipient to schedule an appropriate time, leaving a note on the recipient’s door, leaving the bouquet/arrangement in a covered, secure area, or leaving it with a neighbor.

Midnight Deliveries:

Subject to other shipping disclaimer terms, delivery will be made between 11:00 PM to 11:59 PM on the chosen delivery date. Note: Choose the delivery date a day prior to the occasion.

Fixed Time Deliveries:

While we aim to deliver orders within the selected fixed time slot, subject to other shipping disclaimer terms, delivery could occur +30 or -30 minutes from the chosen time.

Courier Product Deliveries:

For products delivered through courier agencies, the date of delivery is an estimate. Your order may be delivered a day prior or a day after the chosen date. The requested delivery date for such products is non-binding and depends on product availability and the destination.

Delivery to Hospitals, Hotels, Wedding Halls, Hostels, PG, Cantonment, Enclosed Premises:

Specific instructions and information are required for successful delivery to these locations, including full addresses, telephone numbers, room numbers, and names of recipients.

Delivery at Remote Locations:

Delivery is available only in cities in our database. Remote locations are subject to availability, and no commitments can be made for exact delivery times.

National Holidays and Impediments:

No deliveries will be made on national holidays, and in case of impediments like floods, heavy rains, national bandhs, elections, curfews, or festivals, we reserve the right to reschedule the delivery to another date.

Deemed Delivery:

Under any class or category of orders, Jensquare will attempt delivery only once. Deemed Delivery occurs in cases such as a wrong shipping/delivery address, recipient not available, premises locked, or recipient refusing to accept the delivery.

If you have placed two or more identical orders by mistake, you shall inform the same to Jensquare. Jensquare shall give a full refund for the duplicate order, provided that the order has not been prepared or delivered. In any case Jensquare discovers that the same order has been made twice, it shall try to contact the customer to confirm the order. If the customer is not contactable, Jensquare shall be free to take the final decision on behalf of the customer.

You agree to pay the price applicable and displayed for the product or service on our Website at the time you submitted your order, the delivery fees for the delivery service you selected, if any, or any applicable taxes (defined below). You will be solely responsible for payment of all taxes (other than taxes based on Jensquare’s income), fees, duties, and other governmental charges, and any related penalties and interest, arising from the purchase of the products and services not withheld by Jensquare.

All payments are non-refundable (except as expressly set forth in these Terms and Conditions). We reserve the right to charge late fees on all due payments required to be made by the customer which shall be equivalent to the higher of:

1. a) 1.5% (one point five percent) per month on the unpaid balance; or
2. b) the highest rate prescribed under the applicable law.

You agree to pay for all collection costs, attorney’s fees, and court costs incurred in the collection of past due amounts.

“Convenience Charge” may be levied by Jensquare for facilitation of choosing a product/s and book the delivery, anywhere in India, without visiting our physical store. This covers Jensquare’s Internet and system handling costs.

Such Convenience Charges are correlated to the order value.

Order delivery is entirely subject to the payment credited in Jensquare’s account. Unless payment is received by us, the order will not be processed. Jensquare accepts payment via Visa, Master Card, RuPay, Paypal, and American Express Debit and Credit Cards, Internet Banking, Digital wallets, and UPI. All domestic and international cards are accepted by Jensquare.

You acknowledge that while making a transaction on the website, you are not using any Credit or Debit card, digital wallet, or UPI id fraudulently, and you are duly authorized to use such a card or payment mechanism. You agree to provide accurate and correct information about your card or the payment mechanism for such a transaction. The liability for the use of a card or any payment mechanism fraudulently will be on you, and the onus to ‘prove otherwise’ shall be exclusively yours. Jensquare doesn’t take responsibility for any transaction that is processed without your consent and knowledge. The cardholder or the holder of any payment mechanism is solely and totally liable for the transactions and the amount charged to his/her A/c.

All payments made against the purchases on the Website by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. The website will not facilitate transactions with respect to any other form of currency concerning the purchases made on the Website.

Before shipping/delivering your order to you, Jensquare may request you to provide supporting documents (including but not limited to Govt. issued ID) to establish the ownership of the payment instrument used by you for your purchase. This is done in the interest of providing a safe online shopping environment to our users.

It is hereby further clarified that:

Transactions, transaction price, and all commercial terms such as delivery, dispatch of products, etc. are as per principal-to-principal bipartite contractual obligations between the customer and

1. a) Jensquare, and the payment facility provided on the Website is merely used by the customer and Jensquare to facilitate the completion of the transaction.

b) You understand, accept, and agree that the payment facility made available on the Website is neither a banking nor financial service but is merely a facilitator providing an electronic, automated online electronic payment, receiving payment through Cash On Delivery, using the existing authorized banking infrastructure and credit card payment gateway networks.

Subject to the terms of use and your registration on our Website, you agree to receive communications from Jensquare by e-mail, SMS, or any other communication made electronically, verbally, or physically through post. You agree that all agreements, notices, disclosures, and other communications that Jensquare provides to you by e-mail or in any other aforementioned mediums satisfy any legal requirement that such communications be in writing.

In some cases, we will be contacting the recipient before delivery. If you wish we do not contact the recipient, please call our Customer Care at +91 98848 40784 between 9:00 am to 6:00 pm to notify them about the same.

Jensquare, being an occasion-based gifting business, provides certain occasion reminder services wherein Jensquare would remind you in future year(s) concerning certain occasions. For this purpose, you agree to give your consent to be contacted by Jensquare through SMS, phone call, and e-mail on your registered phone number and email id to assist you with the free occasion reminder service.

At Jensquare, we are dedicated to providing excellent products and services, aiming to not only meet but exceed your expectations. Note: Complaints must be lodged within 48 (forty-eight) hours from the time of delivery; otherwise, we will not be able to register any complaints. Complaints against non-delivery must be made within 15 (fifteen) days from the date of delivery, after which we will not be able to register any complaints. In the case of a defective or poor-quality product complaint, we will arrange for a replacement. For quality assurance, a reverse pick-up may be necessary before proceeding with redelivery.

At Jensquare, we adhere to a no-return policy. However, if you receive a damaged, defective, or incorrect product, please promptly report the issue to our customer support team within 48 hours of delivery, accompanied by an image of the item received. Our team will reach out to you for additional details if necessary.

You have the following options:

Request a re-delivery of the product.
Opt for a refund in the form of a gift certificate (refunded within 24 hours).
Choose a refund in the original mode of payment (amount reflected in your account within 7-10 working days as per standard banking timelines).
Refunds are not offered in the following cases:

Flowers, Plants, Cakes, Sweets, or any perishable items delivered to an incorrect address provided by the sender.
The recipient is not present at the delivery address provided by the sender or refuses to accept the delivery.
Product quality concerns arising from improper handling.

Please note:
Complaints must be filed within 48 hours from the time of delivery; afterward, we will be unable to register any complaints.
Complaints regarding non-delivery need to be reported within 15 days from the date of delivery.
For quality assurance, a reverse pick-up may be necessary before redelivery.
We do not entertain requests for product exchanges.
If we are unable to supply all or part of your order, we will promptly notify you and reimburse the payment for the undelivered portion.
Online refunds will be processed by Jensquare upon confirmation via email or phone call to the customer. Once processed, it takes 10 to 15 business days to reflect in your account, following standard banking timelines.

Products can only be considered for return if they fall within the warranty period, as specified in the warranty terms available under product information on the Jensquare website. Warranty coverage, addressing manufacturing defects, is applicable to all orders placed through the website.

The warranty can be availed exclusively for manufacturing defects and is not applicable to defects resulting from mishandling of the products or normal wear and tear.

These Terms and Conditions provide you with a personal, revocable, non-exclusive, non-transferable license to use this Website conditioned on your continued compliance with these Terms and Conditions. This limitation of liability section shall prevail over any conflicting or inconsistent provision contained in any of the documents comprising these Terms and Conditions. It is up to you to take precautions to ensure that whatever you select for your use is free of such items as viruses, worms, trojan horses, and other items of a destructive nature.

Jensquare and its affiliates will not be liable for any damages of any kind arising in relation to the following:

The use or consumption of products procured/manufactured by third parties; or
The products delivered to you by any third party. Jensquare assumes no responsibility for examining or evaluating third-party products and services. Jensquare does not warrant the offerings of any third-party products. Jensquare does not endorse, in any way, any third-party products or services or the website’s content thereof. Any claim in respect of the same shall be made directly with the third party.
If Jensquare is unable to deliver your order, a complete refund will be made. However, Jensquare shall not be liable for any other charges, loss of profits, emotional stress, or any other liability, etc., caused due to such non-delivery.

If Jensquare finds any customer involved in any fraudulent transaction on the website, it may recover the cost of products, collection charges, and lawyer’s fees from the concerned customer using the website fraudulently. Such recovery shall not prejudice the rights of Jensquare to initiate legal proceedings against such customer for his/her unlawful activities.

Due to a significant surge in orders during Valentine’s Day and Raksha Bandhan, the delivery status confirmation by email and SMS may arrive a little later. Jensquare strives hard to ensure the orders are delivered on time, and in case of any delay due to a huge rush in orders, Jensquare shall intimate the same to you and attempt to deliver the order as soon as possible.

Jensquare’s customer care team is on its toes to ensure that you have a great experience with Jensquare. However, during the Valentine week and Raksha Bandhan, there may be a slight delay in getting a response from the customer care team. In such situations, you are requested to be patient. In case you have dropped us an email, be assured that it is being reviewed and will be answered back as soon as possible.

While we make the best efforts to ensure we deliver your orders in a timely manner, due to a huge rush during the Valentine week and Raksha Bandhan, we do not offer any fixed time guarantee. Orders are processed on a first-come, first-serve basis, considering delivery areas and other local conditions. For products that are shipped using the services of our courier partners during peak seasons, Jensquare does not guarantee an exact date/time of delivery of such orders.

Your registration data and other information collected through the use of this Website are subject to the Privacy Policy. You acknowledge that through your use of this Website, you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer, as necessary and permitted under the applicable laws. These Terms and Conditions will remain in full force and effect while you are a user of this Website. Your registration on this Website may be terminated at any time at the sole option and discretion of Jensquare or if you are found to be in breach of these Terms and Conditions or if, in the reasonable opinion of Jensquare, you are guilty of conduct which is detrimental to the reputation of Jensquare.

In the event that any provision contained in these Terms and Conditions is held by a court of competent jurisdiction to be contrary to any law, the remaining provisions of these Terms and Conditions will remain in full force and effect.
